Please read these Terms of Service ("Terms") before using the Expect Miracles Surrogacy ("EMS") website and services. By using the website, creating an account or submitting an application, you agree to these Terms and our Privacy Policy.
1. Eligibility and Accounts
You must be at least 18 years old. You are responsible for keeping your login details confidential and for activity on your account. Information you submit must be truthful, complete and current.
2. Our Services
EMS is a surrogacy agency that matches surrogates with intended parents and coordinates the process with licensed medical, legal and financial professionals. The website is informational and does not itself create a contract or a match.
3. Applications
Submitting an application does not guarantee acceptance or a match. EMS may accept, decline or pause an application based on its screening criteria. Misrepresenting information may lead to removal from our program.
4. Fees and Compensation
Fees, surrogate compensation and reimbursements are set out in the written agreements between the parties and in any legal escrow arrangement. Figures shown on the website or in profiles are informational and subject to those agreements.
5. No Medical or Legal Advice
Content on this site is general information, not medical or legal advice. Medical decisions are made by licensed medical professionals, and legal agreements are handled by licensed reproductive attorneys. EMS coordinates these processes but does not direct them.
6. Confidentiality
Parties agree to keep confidential the personal information shared during matching and the journey, and to use it only for that purpose.
7. Acceptable Use
You agree not to:
- Submit false or misleading information, or impersonate another person
- Attempt to access accounts, data or systems you are not authorized to use
- Scrape, copy or republish profiles, photos or content from the site
- Interfere with the security or operation of the website
8. Content and Intellectual Property
The website, its text, design and logo belong to EMS or its licensors. By uploading photos or text for your profile, you allow EMS to use them to operate the service and, for approved public profiles, to display them on the site.
9. Disclaimers and Limitation of Liability
The website is provided "as is." To the fullest extent allowed by law, EMS is not liable for medical outcomes, disputes between parties, or the acts of independent third-party providers such as clinics, attorneys and escrow companies, and EMS's total liability is limited to the fees paid to EMS under your program agreement.
10. Termination
Services end under the terms of your signed program agreement. EMS may suspend or close an account that violates these Terms.
11. Governing Law
These Terms are governed by the laws of the State of California. Disputes will be resolved through binding arbitration in San Diego, California, except where the law does not allow it.
